Chairman Steve Harrelson

House Judiciary Committee

Arkansas State Legislature                                                                           January 26, 2009

Mr. Chairman,

Analyzing your position regarding HB 1093 designed to reign in the illegal Mexican & OTM invasion and language to curb non-mandated funding and/or services being dispensed to the unwelcome hordes, you take issue with the following categories.

l. You say you have not decided what your position is.

2. It is a Federal Government responsibility.

3. Costs

With reference to your position, “I have not decided”.  I will be euphemistic Mr. Chairman; keen prevarication is the hallmark of a politician. It is commonly known throughout the Capital and the Arkansas Friendship Coalition that you are working extremely hard to defeat HB 1093.

Federal responsibility: Border security, along with hiring, harboring, aiding & abetting, and transporting illegals is indeed a responsibility of the Federal government, but not in toto.  As an attorney you should be aware of 8 USC, Sec. 1325, 1324a, 1324c, & 1644—which plainly states, among other things that ALL law enforcement is directed to apprehend those individuals and/or corporations hiring, harboring, aiding & abetting, and transporting illegals. Many lawmakers such as you are continually regurgitating the bromide that it is the sole responsibility of the federal government to secure borders and regulate alien population.  This is only partially true. Am I to understand your position is for citizens living in the sovereign state of Arkansas sit idly by and allow our state/citizens to be overrun by uneducated, disease ridden, poverty stricken illegal foreign nationals because the Feds are constitutionally corrupt and refuse to enforce Article IV, Section IV? Who pays? No Mr. Chairman, we are not going to allow that to happen. You are embracing our waffling Governor’s position, you know the one “Legal is legal, and illegal is illegal, and we’ve got to find out what’s legal”. I would remind you that in this crisis there is no room for partisan politics.

Now comes Judiciary member Jim Nickels’ profound observation regarding the transporting of illegals, “If a couple fall in love and get married and she’s an illegal…….”   Rep. Nickels, it is against the law making your hypothetical example moot. Hopefully, this is not the depth of thought and discourse in the entire committee.

Mr. Chairman, you speak of costs to implement 1093 and I am so glad you’ve brought up the subject of cost, i.e. my tax dollars. I will point out some of the costs for NOT implementing the Bill.  Hundreds of millions of Arkansas tax dollars are being spent yearly on illegals in this state to satisfy the demands of the Arkansas Friendship Coalition and others, while many of these expenditures/services are not available to citizens.  Have you actually made investigations into the horrendous costs of illegals in public schools, health clinics, AHEC, HUD, WIC, Medicaid, Arkids First, Hospitals, E.R.’s, traditional doctor’s offices, or witnessed the use of debit cards by illegals? How about police stations, jails, prisons, witness gang activity, graffiti, drug & human smuggling bands, ad infinitum?  All these services are devoted to illegals and you wonder what the cost would be for the state police to enforce HB 1093? Give me a break!  Shut of the funding spigot, Mr. Chairman. Whose side are you on and what’s your reward?  Are you aware there are more policing organizations in this state armed to the teeth, fully militarized,  than you can shake a stick at? Citizens are sick of these illegal invaders being treated by equally illegal government acts as an endangered species, subsidized by our tax dollars.

The most egregious act, i.e. grand taxpayer theft, was the passage of the Bill which mandated free pre & postnatal care to illegal Mexican and OTM women, compliments of Gov. Huckabee and the Arkansas Legislature. At the conclusion of the pregnancy, already thousands upon thousands of anchor babies have and are being produced…proclaimed American citizens. Anchor babies have the right to remain on welfare until 25 years of age and the immediate right to bring in from their native country, their immediate family.  Only corrupt fools could create such suicidal legislation, i.e. an unconstitutional, illegal attack on culture, heritage and rule of law.  Are you aware of the cumulative cost and numbers of illegals who have and are participating in these unconstitutional programs since the inception beginning July 5, 2005?  Of course not.  Do you care?  That remains to be seen. In view of all the economic rape of citizens, Gov. Beebe comes forth with his vote-seeking increase in Medicaid and applauding the increase in the national SCHIPPs program, while the illegal invasion continues unabated.

Members of the Judiciary Committee hold the key to the survival of middleclass Arkansans. We demand an open, full House debate on the crisis that is reducing this nation to political and economic rubble, i.e. economic & political genocide of the middleclass, and if not stopped the result will be a bellicose multicultural Gulag. The OBGYN expense alone required to discharge the pre & postnatal expense would more than pay for proper policing required by 1093.

I have FOIed DHS during the early years and the results were staggering…and this is not counting DHS cover-ups.   Go to www.arkansasfreedom.com and scroll down to FOI’s for documented details.

There is the matter of gross irregularities being committed by the Arkansas State Police and their influence peddlers, advertising in Spanish in tri-color print and radio (other agencies are also doing TV ads in Spanish, paid for by taxpayers), issuing drivers’ licenses to illegals, turning drunken and/or traffic wreck offenders loose, but have the time and resources for their expensive “Click it or Ticket” campaigns directed at citizens.  The matter of ASP issuing driver’s licenses to illegals now resides in the Arkansas Supreme Court and is being defended by that paragon of virtue A.G. Dustin McDaniel against citizen wishes and Constitutional demands.

Chairman Harrelson, the cost of maintaining and dealing with the illegal and OTM crisis is out of sight and is increasing exponentially, while illegals are depressing wages and stealing jobs from citizens who are struggling mightily in diverse areas as we enter the throes of a depression.  In the meantime your buddies in the Poultry Federation, Chambers of Commerce, Farm Bureau Insurance led by the Delta planter (with all his AG subsidies) who wants to be the president of the U. of A. system, various contractors, and by all means the Catholic & other churches …all using their millions to fight the enforcement of U.S. and State immigration laws, while economically & politically gorging themselves at citizens’ expense.  Where is Morril Harriman in this picture?  See “Arkansas’ own trail of Tears” cartoon www.arkansasfreedom.com .

Mr. Harrelson, the matter of illegals in our state and Republic is first and foremost a Rule of Law issue.  The issue is larger than your judicial committee, or any committee for that matter.  Simply stated, depending on polling, 70-90% of Arkansans demand the illegal Mexican & OTM invasion be curtailed this session.  Do you agree that it would not be fair in all its ramifications for your small committee to kill this Bill and of equal importance there are those in your committee who may have vested economic and political interests (you included) in keeping illegals in our state and expanding the magnet?

If for no other reason than in the spirit of fair play—send HB 1093 to the full House and let it be voted on by all elected Representatives.

Can we count on objective leadership in the Judicial Committee rather than the demands of unscrupulous powerbrokers, some previously mentioned?

Finally, one disturbing outburst by a legislator last week who stridently stated he “would not vote for any Republican Bill” and besides that, he had friends “who want more cheap illegal labor”, followed by “I don’t have to take this Bull Crap!”…all said to some of his lady constituents who happened to be Republicans.  I cannot describe in words my feelings toward this Buffoon who is willing to bathe himself publicly in corruption.  I will refrain, for the present, from calling him out.

This is no time for self-serving political “partisanship”, deal from an honest deck.

Kindest regards,

Joe McCutchen

Fort Smith
